{"id":10896,"date":"2016-10-18T16:43:54","date_gmt":"2016-10-18T20:43:54","guid":{"rendered":"https:\/\/jss.ca\/living-safety-information\/%e3%83%81%e3%83%83%e3%83%97tips%e3%81%a8%e5%bf%83%e4%bb%98%e3%81%91gratuities%e3%81%ab%e9%96%a2%e3%81%99%e3%82%8b%e6%96%b0%e3%81%97%e3%81%84%e8%a6%8f%e5%89%87\/"},"modified":"2021-04-19T16:47:34","modified_gmt":"2021-04-19T20:47:34","slug":"cleo-new-rules-tips-gratuities","status":"publish","type":"post","link":"https:\/\/jss.ca\/en\/news\/cleo-new-rules-tips-gratuities\/","title":{"rendered":"New rules about tips and gratuities"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-11696\" src=\"https:\/\/jss.ca\/wp-content\/uploads\/2015\/12\/CLEO_On-the-Rader-1.jpg\" alt=\"CLEO_On the Rader\" width=\"624\" height=\"187\" srcset=\"https:\/\/jss.ca\/wp-content\/uploads\/2015\/12\/CLEO_On-the-Rader-1.jpg 624w, https:\/\/jss.ca\/wp-content\/uploads\/2015\/12\/CLEO_On-the-Rader-1-300x90.jpg 300w\" sizes=\"auto, (max-width: 624px) 100vw, 624px\" \/><\/p>\n<p>Recent changes to Ontario&#8217;s Employment Standards Act (ESA) mean that there are now rules about the handling of tips and gratuities in the workplace.<br \/>\nThis month&#8217;s On the Radar looks at these new rules, including when workers get to keep tips and what they can do to protect their rights.<\/p>\n<h2>When workers get to keep tips<\/h2>\n<p>In workplaces where people leave tips, like hair and nail salons, restaurants, bars, and taxis, employers must now let workers keep the tips that people give them.<br \/>\nThat&#8217;s the general rule in the ESA.<br \/>\nBut there are\u00a0<strong>2 exceptions<\/strong>\u00a0to this general rule:<\/p>\n<ol>\n<li>The employer can decide that tips go into a &#8220;pool&#8221; for sharing. And the employer can also decide what share of the pool a worker gets.<\/li>\n<li>The employer might have to follow another law or a court order. For example, a court order could say that an employer has to take money out of a worker&#8217;s wages and tips to pay for something that the worker owes, like child support.<\/li>\n<\/ol>\n<h2>When employers can share in the tips<\/h2>\n<p>An employer who decides that tips go into a pool for sharing does\u00a0<strong>not<\/strong>\u00a0usually get a share for themselves.<br \/>\nBut the rules now say that an employer who owns all or part of the business\u00a0<strong>can<\/strong>\u00a0share in the tips if they regularly do a lot of the same work as:<\/p>\n<ul>\n<li>workers who are sharing the tips, or<\/li>\n<li>workers in the same industry who normally get tips.<\/li>\n<\/ul>\n<p>For example, a restaurant owner who spends a lot of time serving food can share in the tips.<\/p>\n<h2>Tips aren&#8217;t wages<\/h2>\n<p>The ESA does\u00a0<strong>not<\/strong>\u00a0count tips as wages. So, employers still have to pay minimum wage to workers who get tips.<br \/>\nBut there&#8217;s more than one minimum wage. For example, there&#8217;s a general minimum wage, a minimum wage for students, and a minimum wage for people who serve liquor.<br \/>\nThe Ministry of Labour has information about the different\u00a0<a href=\"http:\/\/cleo.us4.list-manage1.com\/track\/click?u=acaece29df8d07c95ef84a763&amp;id=d3752ab91e&amp;e=89e4d80904\" target=\"_blank\" rel=\"noopener\">minimum wage rates<\/a>.<\/p>\n<h2>Reporting tips as income<\/h2>\n<p>Workers should keep track of the tips they get, whether they keep their own tips or get a share of tips from a &#8220;pool&#8221;.<br \/>\nTips are income from employment so workers should include the amount in their income tax returns.<br \/>\nAn employer who puts tips in a pool and decides what share of the tips to give a worker has to include the amount on the worker&#8217;s T4 statement. The worker uses the information from the T4 statement on their income tax return.<br \/>\nOtherwise, workers are supposed to report tips themselves when they do their income tax.<\/p>\n<h2>Making a claim against an employer<\/h2>\n<p>If an employer does not follow the rules about tips, a worker might be able to get the money they&#8217;re owed by\u00a0<a href=\"http:\/\/cleo.us4.list-manage1.com\/track\/click?u=acaece29df8d07c95ef84a763&amp;id=975077aadc&amp;e=89e4d80904\" target=\"_blank\" rel=\"noopener\">making a claim<\/a>\u00a0with the Ministry of Labour.<br \/>\nWorkers have\u00a0<strong>up to 2 years<\/strong>\u00a0to make a claim from the date the employer owes the money.<br \/>\nMost people don&#8217;t make claims against an employer that they&#8217;re still working for. This is because the\u00a0<a href=\"http:\/\/cleo.us4.list-manage2.com\/track\/click?u=acaece29df8d07c95ef84a763&amp;id=9080b81a6d&amp;e=89e4d80904\" target=\"_blank\" rel=\"noopener\">laws to protect workers<\/a>\u00a0don&#8217;t stop employers from firing their workers.<br \/>\nAnd if a worker is fired, it&#8217;s up to them to take action against the employer to get the money the employer owes them.<br \/>\nThe ESA says that employers can&#8217;t punish workers for asking about their rights or acting on their rights.
