It also talks about some other things that people on assistance should know if they get child or spousal support.<\/p>\n<h4>Child support \u2013 what&#8217;s new<\/h4>\n<p>There&#8217;s a new rule that Ontario Works (OW) and the Ontario Disability Support Program (ODSP) no longer reduce a person&#8217;s assistance because they get <strong>child support<\/strong>.<br \/>\nPeople who get money from OW or ODSP now get to keep the child support payments <strong>and<\/strong> the full amount of their financial assistance from OW or income support from ODSP.<br \/>\nAs well, OW or ODSP will <strong>not<\/strong> refuse, reduce, or cut off assistance because someone does <strong>not try<\/strong> to get child support.<br \/>\nThe government got rid of the rule that said people had to make &#8220;reasonable efforts&#8221; to try to get child support from their child&#8217;s other parent.<\/p>\n<p><strong><span style=\"color: #3366ff;\">When the changes apply<\/span><\/strong><br \/>\nThese changes start:<\/p>\n<ul>\n<li>January 1, 2017, for people who get income support from ODSP<\/li>\n<li>February 1, 2017, for people who get financial assistance from OW<\/li>\n<\/ul>\n<p>But the right to keep the full amount of social assistance <strong>and<\/strong> the child support payment only applies to child support that&#8217;s <a href=\"http:\/\/www.cleo.on.ca\/en\/publications\/sup-payt\/do-i-have-try-get-support\" target=\"_blank\" rel=\"noopener\">owed for periods of time after these dates<\/a>.<\/p>\n<h4>Spousal support \u2013 what didn&#8217;t change<\/h4>\n<p>Unlike child support, getting spousal support payments continues to affect the amount of assistance a person gets from OW or ODSP.<br \/>\nOW or ODSP reduces the amount of a person&#8217;s assistance by the amount of spousal support they get.<br \/>\nAnd OW or ODSP <strong>can<\/strong> refuse, reduce, or cut off assistance if a person does not make <a href=\"http:\/\/www.cleo.on.ca\/en\/publications\/sup-payt\/what-will-ow-or-odsp-expect-me-do-get-support\" target=\"_blank\" rel=\"noopener\">reasonable efforts<\/a> to get spousal support from someone who is or was their <a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/family-law\/what-spousal-support#94877\" target=\"_blank\" rel=\"noopener\">spouse, as defined by family law<\/a>.<br \/>\nBut not everyone has to <a href=\"http:\/\/www.cleo.on.ca\/en\/publications\/sup-payt\/what-can-i-do-if-support-payments-are-late-or-not-paid\" target=\"_blank\" rel=\"noopener\">try to get spousal support<\/a>. For example, if a person&#8217;s spouse is violent towards them or their child, they might not have to try to get support.<\/p>\n<h4>Spousal support \u2013 what&#8217;s new<\/h4>\n<p>OW or ODSP <strong>no longer<\/strong> reduces a person&#8217;s assistance by the amount of their spousal support if they do <strong>not get<\/strong> the support that they\u2018re owed.<br \/>\nIt&#8217;s only if they get the money that OW or ODSP deducts the amount from their assistance.<br \/>\nAnd while people used to be able to have the <a href=\"http:\/\/www.mcss.gov.on.ca\/en\/mcss\/programs\/familyResponsibility\/\" target=\"_blank\" rel=\"noopener\">Family Responsibility Office<\/a> send their support payments directly to OW or ODSP, they can&#8217;t do that anymore. This was called &#8220;assigning&#8221; their support payments.<br \/>\nUnder the new rules, agreements to have the Family Responsibility Office send support payments to OW or ODSP are cancelled.<br \/>\nInstead, the Family Responsibility Office sends support payments directly to the people who are owed support.<\/p>\n<h4>Getting legal help<\/h4>\n<p>People who need advice or help dealing with OW or ODSP can <a href=\"http:\/\/www.legalaid.on.ca\/en\/contact\/contact.asp?type=cl\" target=\"_blank\" rel=\"noopener\">contact a community legal clinic<\/a>.<br \/>\nAnd if they disagree with a decision by OW or ODSP, they may be able to appeal that decision to the <a href=\"http:\/\/yourlegalrights.on.ca\/organization\/81366\" target=\"_blank\" rel=\"noopener\">Social Benefits Tribunal<\/a>.
