Japanese Social Services is wholly responsible for the accuracy of this translation, produced with permission of CLEO.<\/p>\n<h1><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3948 aligncenter\" src=\"https:\/\/jss.ca\/wp-content\/uploads\/2017\/07\/e1499906814282-300x89.png\" alt=\"\" width=\"539\" height=\"160\" srcset=\"https:\/\/jss.ca\/wp-content\/uploads\/2017\/07\/e1499906814282-300x89.png 300w, https:\/\/jss.ca\/wp-content\/uploads\/2017\/07\/e1499906814282.png 577w\" sizes=\"auto, (max-width: 539px) 100vw, 539px\" \/><\/h1>\n<p>This month&#8217;s On the Radar talks about the process that the Ontario Disability Support Program (ODSP) uses when they do a medical review.<br \/>\nThere&#8217;s more detailed information on the\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/social-assistance\/i-have-medical-review-date-ontario-disability-support-program\" target=\"_blank\" rel=\"noopener\">Steps to Justice<\/a>\u00a0website.<\/p>\n<h3>Who gets a medical review date<\/h3>\n<p>To\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/social-assistance-and-pensions\/i-have-disability-can-i-get-ontario-disability\" target=\"_blank\" rel=\"noopener\">qualify for income support<\/a>\u00a0from ODSP, a person usually has to prove that they&#8217;re\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/social-assistance-and-pensions\/when-i-apply-ontario-disability-support-program\" target=\"_blank\" rel=\"noopener\">a person with a disability<\/a>.<br \/>\nWhen the\u00a0<a href=\"http:\/\/stepstojustice.ca\/glossary\/disability-adjudication-unit\" target=\"_blank\" rel=\"noopener\">Disability Adjudication Unit<\/a>\u00a0or the\u00a0<a href=\"http:\/\/stepstojustice.ca\/glossary\/social-benefits-tribunal\" target=\"_blank\" rel=\"noopener\">Social Benefits Tribunal<\/a>\u00a0decides that someone is a\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/social-assistance-and-pensions\/when-i-apply-ontario-disability-support-program\" target=\"_blank\" rel=\"noopener\">person with a disability<\/a>, they may set a medical review date.<br \/>\nThey do this if they think that the person&#8217;s health might\u00a0<strong>improve<\/strong>.<\/p>\n<h3>Medical Review Package<\/h3>\n<p>The Disability Adjudication Unit handles medical reviews. When they&#8217;re ready to do someone&#8217;s medical review, they send them a\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/social-assistance\/i-have-medical-review-date-ontario-disability-support-program\" target=\"_blank\" rel=\"noopener\">Medical Review Package<\/a>. The package has instructions and forms that have to be filled out and sent back within\u00a0<strong>90 days<\/strong>.<\/p>\n<h3>Completing Medical Form Part A<\/h3>\n<p><a href=\"http:\/\/stepstojustice.ca\/common-question-step\/1-learn-about-medical-form-part\" target=\"_blank\" rel=\"noopener\">Medical Form Part A<\/a>\u00a0is already partly filled out when the person gets the Medical Review Package. It has information about the person&#8217;s medical conditions from the last time they had to show ODSP that they qualified for\u00a0<a href=\"http:\/\/stepstojustice.ca\/glossary\/income-support\" target=\"_blank\" rel=\"noopener\">income support<\/a>\u00a0as a person with a disability.<br \/>\nOne of the following &#8220;approved health professionals&#8221; must complete the Medical Form Part A:<\/p>\n<ul>\n<li>a family doctor or a specialist<\/li>\n<li>a psychologist or a psychological associate<\/li>\n<li>an optometrist<\/li>\n<li>a nurse practitioner<\/li>\n<\/ul>\n<p>And for someone to keep getting income support as a person with a disability, they\u00a0<strong>must<\/strong>\u00a0send in a completed Medical Form Part A.<\/p>\n<h3>Completing Medical Form Part B<\/h3>\n<p>There\u2019s\u00a0<strong>no need<\/strong>\u00a0to send in\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/2-learn-about-medical-form-part-b\">Medical Form Part B<\/a>unless the person has a new medical condition that\u2019s\u00a0<strong>not listed<\/strong>\u00a0in Part A.<br \/>\nEven if they do have a new condition, they\u00a0<strong>don\u2019t<\/strong>have to complete Medical Form Part B if the health professional who completes Medical Form Part A says:<\/p>\n<ul>\n<li>the physical or mental health problems listed in Part A have\u00a0<strong>not\u00a0<\/strong>gotten significantly better, and<\/li>\n<li>the medical conditions listed in Part A are likely to stay the same or get worse.<\/li>\n<\/ul>\n<p>But there are times when it\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/1-learn-about-medical-form-part\" target=\"_blank\" rel=\"noopener\">can be helpful<\/a>\u00a0to have a health professional complete\u00a0<strong>Medical Form Part B<\/strong>, even if it&#8217;s not necessary.<br \/>\n<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/2-learn-about-medical-form-part-b\" target=\"_blank\" rel=\"noopener\">Medical Form Part B<\/a>\u00a0has 2 sections:<\/p>\n<ul>\n<li>Health Status Report<\/li>\n<li>Activities of Daily Living Index<\/li>\n<\/ul>\n<p><strong>Health Status Report<\/strong><br \/>\nThis must be filled out by an\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/2-learn-about-medical-form-part-b\" target=\"_blank\" rel=\"noopener\">approved health professional<\/a>.<br \/>\nIn the Health Status Report, the health professional lists any medical conditions the person has that are not listed in Medical Form Part A.<br \/>\nThe health professional must say whether a medical condition is likely to:<\/p>\n<ul>\n<li>improve<\/li>\n<li>stay the same<\/li>\n<li>get worse<\/li>\n<\/ul>\n<p>Or, they can say that they don&#8217;t know.<br \/>\nAnd they must give other information about the medical condition, for example, how it affects the person.<\/p>\n<p><strong>Activities of Daily Living Index<\/strong><br \/>\nThere&#8217;s a longer list of\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/2-learn-about-medical-form-part-b\" target=\"_blank\" rel=\"noopener\">approved health professionals<\/a>\u00a0who can complete this form.<br \/>\nIn the Activities of Daily Living Index, a health professional describes how much a person&#8217;s health problems limit their ability to:<\/p>\n<ul>\n<li>work<\/li>\n<li>look after themselves<\/li>\n<li>take part in activities at home and in the community<\/li>\n<\/ul>\n<p>The Activities of Daily Living Index does not have to be filled out by the same health professional who fills out the Health Status Report.<\/p>\n<h3>Completing other forms in the Medical Review Package<\/h3>\n<p>The\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/3-learn-about-other-forms-medical-review-package\" target=\"_blank\" rel=\"noopener\">2 other forms<\/a>\u00a0in the Medical Review Package are:<\/p>\n<ul>\n<li>Consent to the Release of Medical Information<\/li>\n<li>Self Report<\/li>\n<\/ul>\n<p>They don&#8217;t have to be completed by a health professional.<\/p>\n<h3>Sending in the Medical Review Package<\/h3>\n<p>The completed forms must be sent to the Disability Adjudication Unit within\u00a0<strong>90 days<\/strong>.<br \/>\nBut a person can\u00a0<a href=\"http:\/\/www.mcss.gov.on.ca\/en\/mcss\/programs\/social\/odsp\/income_support\/part_two.aspx\" target=\"_blank\" rel=\"noopener\">contact the Disability Adjudication Unit<\/a>\u00a0if they need more time. For example, they might not find a health professional to complete the forms in time.<\/p>\n<h3>Getting a decision<\/h3>\n<p>The Disability Adjudication Unit looks at the completed Medical Review Package and decides if the person still meets the ODSP definition of a\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-plus\/social-assistance-and-pensions\/when-i-apply-ontario-disability-support-program\" target=\"_blank\" rel=\"noopener\">person with a disability<\/a>.<br \/>\nIf they say that someone is no longer a &#8220;person with a disability&#8221;, ODSP pays income support for\u00a0<strong>3 more months<\/strong>\u00a0and then cuts it off.<\/p>\n<h3>Getting legal help<\/h3>\n<p>If a person&#8217;s income support is cut off, they may be able to\u00a0<a href=\"http:\/\/stepstojustice.ca\/common-question-step\/5-find-out-if-you-can-appeal-sbt-after-asking-internal-review\" target=\"_blank\" rel=\"noopener\">appeal the decision<\/a>.<br \/>\nFor help appealing the decision, they can contact their\u00a0<a href=\"http:\/\/www.legalaid.on.ca\/en\/contact\/contact.asp?type=cl\" target=\"_blank\" rel=\"noopener\">local community legal clinic<\/a>.<\/p>\n<p>This email alert gives general legal information.
