Japanese Social Services is wholly responsible for the accuracy of this translation, produced with permission of CLEO.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3948 aligncenter\" src=\"https:\/\/jss.ca\/wp-content\/uploads\/2017\/07\/e1499906814282-300x89.png\" alt=\"\" width=\"519\" height=\"154\" srcset=\"https:\/\/jss.ca\/wp-content\/uploads\/2017\/07\/e1499906814282-300x89.png 300w, https:\/\/jss.ca\/wp-content\/uploads\/2017\/07\/e1499906814282.png 577w\" sizes=\"auto, (max-width: 519px) 100vw, 519px\" \/><br \/>\nStarting April 30, 2018, most residential landlords and tenants in Ontario will have to use the government&#8217;s new standard lease.<br \/>\nThis month&#8217;s On the Radar explains the rules about using it.<\/p>\n<h4><strong>Who must use it<\/strong><\/h4>\n<p>Most landlords and tenants will have to use the\u00a0<a href=\"http:\/\/www.forms.ssb.gov.on.ca\/mbs\/ssb\/forms\/ssbforms.nsf\/FormDetail?OpenForm&amp;ACT=RDR&amp;TAB=PROFILE&amp;SRCH=&amp;ENV=WWE&amp;TIT=2229E&amp;NO=047-2229E\" target=\"_blank\" rel=\"noopener noreferrer\">standard lease<\/a>. But this does\u00a0<strong>not<\/strong>\u00a0apply to:<\/p>\n<ul>\n<li>places rented for a business<\/li>\n<li>public or\u00a0<a href=\"https:\/\/stepstojustice.ca\/glossary\/subsidized\" target=\"_blank\" rel=\"noopener noreferrer\">subsidized<\/a>\u00a0housing<\/li>\n<li>mobile homes or\u00a0<a href=\"https:\/\/stepstojustice.ca\/glossary\/land-lease-home\" target=\"_blank\" rel=\"noopener noreferrer\">land lease homes<\/a><\/li>\n<li><a href=\"https:\/\/chfcanada.coop\/your-region\/ontario-region\/about-ontario-region\/co-operative-housing-in-ontario\/\" target=\"_blank\" rel=\"noopener noreferrer\">housing co-ops<\/a><\/li>\n<li><a href=\"https:\/\/stepstojustice.ca\/glossary\/sublet\" target=\"_blank\" rel=\"noopener noreferrer\">subletting<\/a><\/li>\n<li><a href=\"https:\/\/stepstojustice.ca\/glossary\/care-home\" target=\"_blank\" rel=\"noopener noreferrer\">care homes<\/a>, for example, retirement homes<\/li>\n<\/ul>\n<p>Landlords and tenants must use the standard lease for rental agreements that are signed\u00a0<strong>on or after April 30, 2018<\/strong>.<br \/>\nThe standard lease form is on the Ministry of Housing website. There&#8217;s a version that people can\u00a0print out and fill in, and another version to\u00a0fill in on a computer\u00a0and then print.<br \/>\nBoth the tenant and landlord must sign the lease no later than the day the tenant is supposed to move in.<br \/>\nAnd the landlord must give the tenant a copy within\u00a0<strong>21 days<\/strong>\u00a0after the tenant signs it and gives it to the landlord.<\/p>\n<h4><strong>Can the form be changed?<\/strong><\/h4>\n<p>Landlords and tenants can only fill in blanks and checkboxes. They can&#8217;t change or cross out any parts of the standard lease form.<br \/>\nBut they can add terms, as long as the terms don&#8217;t go against the law or anything that&#8217;s in the form. There&#8217;s more information about additional terms below.<\/p>\n<h4><strong>If a landlord does not use the standard lease<\/strong><\/h4>\n<p>If a tenant has rented a place without a standard lease, they can write to the landlord and ask them for a standard lease to sign.<br \/>\nThe first time the tenant makes this written request, the law gives them certain rights.<\/p>\n<p><strong>Holding back rent<\/strong><br \/>\nOnce the tenant asks in writing, the landlord has\u00a0<strong>21 days<\/strong>\u00a0to give them a standard lease to sign.<br \/>\nIf the landlord does not do this, the tenant can hold back up to one month&#8217;s rent. They can only hold back rent payments that come due\u00a0<strong>after the 21 days<\/strong>\u00a0have passed.<br \/>\nThe tenant must pay back this rent if the landlord gives them a standard lease to sign\u00a0<strong>within 30 days<\/strong>from when the rent was due. If the landlord does not do this within 30 days, the tenant can keep the rent.<\/p>\n<p><strong>Moving out early<\/strong><br \/>\nThere&#8217;s another right a tenant gets the first time they ask in writing for a standard lease.<br \/>\nIf they originally agreed to a fixed term, such as a year, they don&#8217;t have to stay for the whole term. They can move out by giving 60 days&#8217; notice\u00a0<a href=\"https:\/\/stepstojustice.ca\/common-question-plus\/housing-law\/i-rent-month-month-how-should-i-give-notice-move-out\" target=\"_blank\" rel=\"noopener noreferrer\">as if they had a month-to-month tenancy<\/a>.<br \/>\nBefore the tenant can give this notice, the landlord has\u00a0<strong>21 days to reply<\/strong>\u00a0to the written request.<br \/>\nIf the landlord replies by giving them a standard lease, the tenant can choose not to sign it and can give the 60 days&#8217; notice. They must give the notice\u00a0<strong>within 30 days<\/strong>\u00a0after the landlord gives them the lease.<br \/>\nIf the tenant does\u00a0<strong>not<\/strong>\u00a0want to move out, they can sign the standard lease or do nothing. Doing nothing means that they stay with the agreement they made originally with the landlord.<\/p>\n<h4><strong>Checking the additional terms<\/strong><\/h4>\n<p>Tenants need to read the &#8220;Additional Terms&#8221; section carefully to understand what they&#8217;re agreeing to. The additional terms will be on separate pages, attached to the standard lease form.<br \/>\nThere&#8217;s no limit on how many terms can be added. Some landlords might have several pages of additional terms. Tenants can suggest terms too, but the landlord has to agree to add them.<br \/>\nAdditional terms have to be in plain language and clearly explain what someone can, can&#8217;t, or must do.<br \/>\nAdditional terms are not valid if they go against any of the standard terms.<br \/>\nTerms are also not valid if they conflict with the law, for example, if they say that the tenant:<\/p>\n<ul>\n<li>can&#8217;t have pets<\/li>\n<li>can&#8217;t have roommates or guests<\/li>\n<li>has to pay for repairs<\/li>\n<\/ul>\n<p>If an additional term is not valid, it means the landlord and tenant can&#8217;t make each other follow it, even if they both signed the lease.<br \/>\nBut sometimes it may not be clear whether a term is valid until the\u00a0<a href=\"https:\/\/mailchi.mp\/cleo\/www.sjto.gov.on.ca\/ltb\/\" target=\"_blank\" rel=\"noopener noreferrer\">Landlord and Tenant Board<\/a>\u00a0makes a decision about it.<br \/>\nIf a tenant is not sure what to do, they can contact a\u00a0<a href=\"http:\/\/www.legalaid.on.ca\/en\/contact\/contact.asp?type=cl\" target=\"_blank\" rel=\"noopener noreferrer\">community legal clinic<\/a>\u00a0or\u00a0<a href=\"https:\/\/stepstojustice.ca\/common-question-plus\/housing-law\/how-do-i-find-lawyer-or-paralegal-help-me-my-tenancy-issue\" target=\"_blank\" rel=\"noopener noreferrer\">talk to a lawyer<\/a>.<\/p>\n<p>This email alert gives general legal information.
